North Carolina Supreme Court to revisit school funding

A ruling by the North Carolina Supreme Court on Friday siding with the state controller means the court will revisit a school funding case in which an earlier lineup of justices issued a landmark opinion just four months ago.

In a 5-2 decision, the Supreme Court restored enforcement of a 2021 order by the Court of Appeals that stopped the controller from transferring money from state coffers to agencies for education purposes without the General Assembly’s express approval. A trial judge had directed the controller’s predecessor to transfer the funds — an action the Supreme Court upheld in November. Two new justices joined the bench in January, altering the court’s partisan makeup.

A lawyer for current Controller Nels Roseland told the Supreme Court last month that Roseland remained worried that he or his staff could face criminal and civil penalties for making the transfer with several issues unaddressed. The controller keeps the state’s books and manages cash flow.

Mexican president lashes out at Supreme Court chief justice

Mexico’s president lashed out Wednesday at the chief justice of the country’s Supreme Court, accusing her of promoting rulings favorable to criminal suspects.

President Andrés Manuel López Obrador’s comments opened a new debate over the separation of powers in Mexico, at a time when the Supreme Court is expected to rule on the president’s controversial cuts to election agency funding.

López Obrador has already attacked independent regulatory agencies, slammed the judiciary and cut funding for the National Electoral Institute.

The electoral dispute has led the president to feud with the press, demonstrators and the U.S. State Department. Opponents say the electoral cuts threaten Mexico’s democracy, and have appealed them to the Supreme Court.

López Obrador’s comments Wednesday opened a head-on conflict between the administration and Supreme Court Chief Justice Norma Piña, the first woman to hold that post.

The president was angered after a judge issued an injunction striking down an arrest warrant against Francisco Garcia Cabeza de Vaca, a former governor of the northern border state of Tamaulipas, who had been accused of corruption.


Supreme Court won’t upset Arkansas anti-Israel boycott law

The Supreme Court on Tuesday refused to step into a legal fight over state laws that require contractors to pledge not to boycott Israel.

The justices rejected an appeal on behalf of an alternative weekly newspaper in Little Rock, Arkansas, that objected to a state law that reduces fees paid to contractors that refuse to sign the pledge.

The full federal appeals court in St. Louis upheld the law, overturning a three-judge panel’s finding that it violated constitutional free speech rights.

Similar measures in Arizona, Kansas and Texas were initially blocked by courts, prompting lawmakers to focus only on larger contracts. Arkansas’ law applies to contracts worth $1,000 or more.

Republican legislators in Arkansas who drafted the 2017 law have said it wasn’t prompted by a specific incident in the state. It followed similar restrictions enacted by other states in response to a movement promoting boycotts, divestment and sanctions of Israeli institutions and businesses over the country’s treatment of Palestinians. Israeli officials said the campaign masked a deeper goal of delegitimizing and even destroying their country.


Oregon launches abortion hotline offering free legal advice

Oregon is launching a new abortion hotline offering free legal advice to callers, moving to further defend abortion access after the U.S. Supreme Court overturned Roe v. Wade last summer and eliminated federal protections for the procedure.

The state’s Department of Justice announced the initiative Monday. It is modeled on similar hotlines launched by the attorneys general of New York and Delaware, as states where abortion remains legal have seen an increase in the number of patients traveling from areas where the procedure has been banned or restricted.

“The Hotline will fill an important need in our state for callers to understand the status of our reproductive health laws, including issues related to abortion access,” Oregon Attorney General Ellen Rosenblum said in a news release. “This is especially important because we share a border with Idaho, which has a near-total abortion ban.”

Abortion remains legal at all stages of pregnancy in Oregon, which has worked with California and Washington to promote the West Coast as a safe haven for the procedure.

People can call the anonymous hotline from any state for free legal advice and receive a call back from a lawyer within 48 hours.


Judge asked to dismiss lawsuit over WVa transgender ban

Education officials are asking a federal judge to dismiss a lawsuit challenging West Virginia’s new law that bans transgender athletes from competing in female sports in middle schools, high schools and colleges.

Education and athletic officials said in court documents filed last week that they can’t be held liable for the law, which they didn’t request and largely won’t be responsible for enforcing, the Charleston Gazette-Mail reported.

The American Civil Liberties Union and its West Virginia chapter filed the lawsuit in May on behalf of an 11-year-old transgender girl who had hoped to compete in cross country in middle school in Harrison County. The girl is seeking an injunction to prevent the law from being enforced.

The ban is set to take effect Thursday and will require the state Board of Education to establish rules to determine the means by which local athletic officials can enforce the law.

Attorneys for the West Virginia Board of Education and the West Virginia Secondary School Activities Commission argued that they can’t be held responsible for the law because they aren’t responsible for enforcing it.

Attorneys for Harrison County Schools said the district “was not responsible for and did not pass” the transgender athlete ban and has not caused harm to the girl.

“(The law) was not created by the County Board, and it is not under the County Board’s control,” the response said.

The U.S. Justice Department intervened in the case last month, saying the ban was a violation of federal law.


Most virus-related restrictions lifted for Kentucky courts

Kentucky’s Supreme Court has ended most coronavirus-related restrictions for the state’s court system effective immediately, Chief Justice John D. Minton Jr. said Tuesday.

The high court entered administrative orders eliminating most health and safety requirements related to COVID-19 and expanding in-person court operations, Minton said.

“After the most challenging year in the history of the modern court system, I am pleased to announce that the Supreme Court has lifted most of the COVID-19 restrictions for employees, elected officials and those entering court facilities across the commonwealth,” Minton said.

The court’s action “allows us to begin transitioning back to normal operations,” he added.

The changes include allowing in-person access to court facilities for anyone with court business, except for those who have symptoms, tested positive or have been exposed to COVID-19.

The mask mandate is eliminated for fully vaccinated people entering court facilities and for fully vaccinated court officials and employees, but those not fully vaccinated are strongly encouraged to continue using masks. Judges will be permitted to require people in their courtrooms to wear masks.

The court lifted most restrictions on jury trials but requires continuances, postponements and recusals for attorneys, parties and jurors who are ill or at increased risk of severe illness from COVID-19.
