Ex-Trump lawyer Michael Cohen back in federal prison

President Donald Trump’s former personal lawyer and fixer, Michael Cohen, was returned to federal prison Thursday, after balking at certain conditions of the home confinement he was granted because of the coronavirus pandemic.

Records obtained by The Associated Press said Cohen was ordered into custody after he “failed to agree to the terms of Federal Location Monitoring” in Manhattan.

But Cohen’s attorneys disputed that, saying Cohen took issue with a condition of his home confinement that forbid him from speaking with the media and publishing a tell-all book he began working on in federal prison. The rules also prohibited him from “posting on social media,” the records show.

“The purpose is to avoid glamorizing or bringing publicity to your status as a sentenced inmate serving a custodial term in the community,” the document says.

Cohen has written a tell-all book that he had been preparing to publish about his time working for the Trump Organization, his lawyers said.

“Cohen was sure this was written just for him,” his attorney, Jeffrey Levine, said of the home confinement conditions. “I’ve never seen anything like this.”

A Justice Department official pushed back on that characterization and said Cohen had refused to accept the terms of home confinement, specifically that he submit to wearing an ankle monitor. The official could not discuss the matter publicly and spoke to AP on condition of anonymity.

Cohen legal adviser Lanny Davis called that “completely false,” adding that “at no time did Michael ever object to the ankle bracelet.”

Cohen later agreed to accept all of the requirements of home confinement but was taken into custody nevertheless, Davis said. “He stands willing to sign the entire document if that’s what it takes” to be released.


Court: No new offshore drilling work during federal shutdown

A federal judge in South Carolina has turned back the Trump administration's attempt to continue preparatory work for offshore drilling during the federal government's partial shutdown, issuing a ruling in a federal lawsuit challenging the overall expansion plans.

In his order, U.S. District Judge Richard Gergel halted federal agencies "from taking action to promulgate permits, otherwise approve, or take any other official action" for permits to conduct testing that's needed before drilling work can begin.

The ruling comes a few days after President Donald Trump's decision this week to recall workers at the Bureau of Ocean Energy Management so they could continue to process testing permits for possible drilling off the Atlantic coastline. The recall drew an objection from the U.S. House Natural Resources Committee chairman, Democratic Rep. Raul Grijalva (gri-HAWL-vah) of Arizona. He called on Acting Interior Secretary David Bernhardt to reverse course or provide a briefing on the legal justification for the move.

Earlier this month, South Carolina joined a federal lawsuit opposing the administration's plans to conduct offshore drilling tests using seismic air guns. Gergel is overseeing that case, initially filed by environmental groups and municipalities along the state's coast.

The suit challenges permits for the testing that precedes the drilling itself. It claims the National Marine Fisheries Service violated the Marine Mammal Protection Act, the Endangered Species Act and the National Environmental Policy Act in issuing the permits.


Spain court grants $1.7 billion compensation for oil spill

Spain's Supreme Court has ruled that the captain and the insurer of the Prestige oil tanker must pay more than 1.5 billion euros ($1.7 billion) in compensation for Spain's biggest environmental disaster, when the vessel sank in 2002.

The court said in a statement Thursday that captain Apostolos Mangouras and The London Owners Mutual Insurance Association shall pay the damages to Spain, France and authorities in Spain's Galicia region, as well as to another 269 companies, communities and individuals affected by the spill.

The tanker sprang a leak and sank off northwest Spain, polluting a long stretch of coastline and ruining the area's rich fishing grounds. Years of legal challenges slowed the compensation process.


States urge Supreme Court to hear Kennedy cousin case

Eleven states are asking the U.S. Supreme Court to hear Connecticut's appeal in the murder case of Kennedy cousin Michael Skakel and reinstate his conviction.

The states filed a friend-of-the-court brief on Monday, saying a ruling in Connecticut's favor is needed to thwart excessive appeals that focused on mistakes made by defense lawyers. The court has not yet decided whether to hear Connecticut's appeal.

Skakel, a nephew of Robert F. Kennedy's widow, Ethel Kennedy, cited his trial lawyer's failure to contact an alibi witness in his successful appeal to the Connecticut Supreme Court.

The state court in 2016 upheld Skakel's 2002 murder conviction in the bludgeoning death of Martha Moxley in their wealthy Greenwich neighborhood in 1975, when they were teenagers. But the court reversed that ruling in May and vacated the conviction, after a justice in the 4-3 majority retired and a new justice sided with Skakel - a move that has also drawn scrutiny.

Connecticut prosecutors argue the state high court did not properly weigh the overall performance of Skakel's defense, which they described as vigorous. They say the U.S. Supreme Court needs to correct a misperception by other state and federal courts that any mistake by defense counsel demonstrates incompetence and warrants a new trial.

The friend-of-the-court brief, filed by Utah Attorney General Sean Reyes' office, said allowing the nitpicking of defense lawyer performance produces a variety of problems, including flooding the courts with appeals as a result of lower legal standards and making it harder for defendants to find lawyers willing to undergo such scrutiny.



Chicago, surfer group oppose US Steel settlement in court

The city of Chicago and a surfing organization have told a judge that a proposed federal settlement over U.S. Steel's repeated chemical spills into Lake Michigan is inadequate.

The Chicago Law Department and the Surfrider Foundation urged the federal judge Thursday to impose tougher penalties on the steelmaker for last year's hexavalent chromium discharges from its Midwest Plant in Portage, Indiana, into the region's primary source of drinking water, the Chicago Tribune reported.

The nearly $900,000 in fines and penalties proposed by the federal government fall short when compared with the ecological damage caused by the carcinogenic discharges, according to court documents filed by the city of Chicago and the nonprofit foundation. The settlement also requires the steelmaker to test for hexavalent chromium daily, create a preventative maintenance program and upgrade all pollution monitoring.

"The government's inadequate oversight ... demonstrates the need for Surfrider to remain vigilant," said Mark Templeton, the group's attorney.

The University of Chicago's Abrams Environmental Law Clinic discovered last year that the manufacturing and finishing plant had violated chromium limits in its federal water pollution permit at least four times since 2013. The plant's chromium discharges are limited to 30 pounds a day, while hexavalent chromium is limited to about half a pound a day.
