Supreme Court opens pivotal term with Trump nominee in place

Disputes over a wedding cake for a same-sex couple and partisan electoral maps top the Supreme Court's agenda in the first full term of the Trump presidency. Conservatives will look for a boost from the newest justice, Neil Gorsuch, in a year that Justice Ruth Bader Ginsburg has said will be momentous.
President Donald Trump's travel ban appears likely to disappear from the court's docket, at least for now. But plenty of high-profile cases remain.
The justices will hear important cases that touch on gay rights and religious freedoms, the polarized American electorate, the government's ability to track people without search warrants, employees' rights to band together over workplace disputes and states' rights to allow betting on professional and college sporting events.
Last year, "they didn't take a lot of major cases because they didn't want to be deadlocked 4-to-4," said Eric Kasper, director of the Center for Constitutional Studies at the University of Wisconsin-Eau Claire. "This year, that problem doesn't present itself."
Gorsuch quickly showed he would be an ally of the court's most conservative justices, Clarence Thomas and Samuel Alito, most recently joining them in objecting to the court's decision to block an execution in Georgia.
While justices can change over time, Gorsuch's presence on the bench leaves liberals with a fair amount of trepidation, especially in cases involving the rights of workers.
The very first case of the term, set for arguments Monday, could affect tens of millions of workers who have signed clauses as part of their employment contracts that not only prevent them from taking employment disputes to federal court, but also require them to arbitrate complaints individually, rather than in groups.

S. Korean court says worker's rare disease linked to Samsung

South Korea's Supreme Court said a former worker in a Samsung LCD factory who was diagnosed with multiple sclerosis should be recognized as having an occupationally caused disease, overturning lower court verdicts that held a lack of evidence against the worker.
In a milestone decision that could aid other sickened tech workers struggling to prove the origin of their diseases, the Supreme Court ruled there was a significant link between Lee Hee-jin's disease and workplace hazards and her working conditions.
Lower courts had denied her claim, partly because no records of her workplace conditions were publicly available. The Labor Ministry and Samsung refused to disclose them when a lower court requested the information, citing trade secrets.
In its ruling Tuesday, the court said the lack of evidence, resulting from Samsung's refusal to provide the information and an inadequate investigation by the government, should not be held against the sickened worker.
Instead, it said, such special circumstances should be considered in favor of the worker.
Lee, 33, began to work at a Samsung LCD factory in Cheonan, south of Seoul, in 2002 when she was a high school senior. She evaluated nearly one hundred display panels per hour on a conveyor belt, looking for defective panels and wiping them with isopropyl alcohol. She worked next to assembly lines that used other chemicals.
Three years after she joined Samsung Electronics, she first reported the symptoms of multiple sclerosis, a rare disease that affects the central nervous system. The average age of reporting multiple sclerosis in South Korea is 38. She left Samsung in 2007.
Lee first filed a claim in 2010 with a government agency, which denied her request for compensation. She took her case to the courts and lost twice before Tuesday's victory.

Court: Indiana layoffs of older workers not discrimination

A federal appeals court has ruled against 20 former Lake County employees who claimed their layoffs were driven by age discrimination.
The Seventh Circuit Court of Appeals in Chicago ruled Wednesday that the plaintiffs, many of whom are now in their 70s and 80s, weren't victims of deliberate discrimination.
The Northwest Indiana Times reports falling tax revenues prompted county officials to terminate or send into early retirement employees older than 65 with promises that included a Medicare supplemental insurance plan.
But they later learned that insurance plan was only for retirees and opted to terminate the older workers in 2013 rather than buy another plan.
The court found the county wasn't practicing unlawful age discrimination because it retained a larger group of older employees not covered by that insurance.

High Court ruling may hurt claims of talc link to cancer

A Supreme Court ruling this week could have a "chilling effect" on the many lawsuits filed in St. Louis claiming talcum powder causes a deadly form of cancer in women, including cases under appeal in which stricken women and their survivors have been awarded more than $300 million, experts said Tuesday.
Justices ruled 8-1 Monday that hundreds of out-state-residents can't sue Bristol-Myers Squibb Co. in California state court over adverse reactions to the blood thinner Plavix. It followed a similar ruling in May related to out-of-state injury claims against BNSF Railway Co. Both were seen as wins for companies opposed to "venue shopping," in which those filing suit seek out favorable state courts.
Almost immediately after the Supreme Court ruling, St. Louis Circuit Judge Rex Burlison declared a mistrial in a Missouri state court case in which three plaintiffs, two from out-of-state, sued Johnson & Johnson, claiming its talcum powder caused ovarian cancer.
More than 1,000 others have filed similar lawsuits in St. Louis against Johnson & Johnson, but most don't live in Missouri. Five trials have already taken place over the past 16 months. In four of those cases, jurors awarded more than $300 million combined.
Johnson & Johnson believes that the Supreme Court ruling "requires reversal of the talc cases that are currently under appeal in St. Louis," spokeswoman Carol Goodrich said in an email. She said the ruling "makes it clear that Johnson & Johnson was wrongfully forced to defend itself in multiple trials in Missouri, a state with no connection to the plaintiffs."
Jim Onder, whose suburban St. Louis-based law firm is representing many women and survivors who filed suit, said Missouri is a proper venue because Johnson & Johnson, though based in New Jersey, uses a factory in Union, Missouri, to package and label talcum products. |

Supreme Court declines to hear North Carolina voter ID case

The Supreme Court declined to hear a case Monday about North Carolina's voter ID law, allowing a lower court ruling holding that the law was passed with "discriminatory intent" to prevail.
The Supreme Court's denial of the case means a 4th Circuit Court of Appeals ruling that struck down the law will stand.
In explaining the high court's decision not to take the case, Chief Justice John Roberts wrote that the new governor and attorney general that took office in January 2017 moved to dismiss North Carolina's petition. Roberts also pointed out the "blizzard of filings over who is and who is not authorized to seek review in this Court under North Carolina law." |

Turkish protesters denounce alleged coup plotters at court

Turkish protesters on Monday demanded the death penalty, abolished in Turkey more than a decade ago, for 18 alleged coup plotters on trial for the killing of a military officer who resisted an effort to overthrow the government.
The demonstrators jeered as security forces escorted the defendants into a courthouse in the Turkish capital, Ankara. The crowd also displayed an effigy of Fethullah Gulen, an Islamic cleric based in Pennsylvania who is blamed by Turkey for the failed coup attempt on July 15. The effigy had a noose around its neck. Gulen has denied involvement in the uprising.
Turkey abolished the death penalty as a campaign to join the European Union gained momentum, but President Recep Tayyip Erdogan has said since the coup attempt that Turkey could hold a referendum on reinstating it if parliament fails to pass such a measure. European leaders say any talks on Turkey's bid to join the EU, which faltered years ago, would end if Ankara restores the death penalty.
Relations reached a new low this month because of Turkey's anger over the refusal of some European countries to let Turkish Cabinet ministers campaign for diaspora votes ahead of an April 16 constitutional referendum on increasing the powers of the Turkish president. Supporters of the measure say a more centralized leadership would help Turkey deal with security, economic and other challenges; critics say its approval would fit a pattern of increasingly authoritarian behavior by Erdogan.
The suspects who appeared in court in Ankara are accused of involvement in the shooting of Omer Halisdemir, an officer who was killed after he shot dead Semih Terzi, a renegade military commander who allegedly tried to take over the special forces headquarters in the capital during last year's uprising by some military units.
Suspect Ahmet Kara, who was Terzi's military aide, testified last month that he was duped into participating in the rogue operation without understanding that it was an attempt to overthrow the government. The defendants, whose trial began in February, face life imprisonment if convicted of murder and other crimes.
