Josef Cowan founded our firm over 20 years ago. The following are some questions and answers that discuss his unique qualities and why so many individuals and businesses trust our firm with their legal and business needs.
Q. Why did you become a lawyer?A. I’m the youngest of 6 kids raised by a single mother. We didn’t have much money, so I started working in the construction industry at a very young age. In fact, I started a construction business when I was 17 years old, and that company is still in existence and has over 400 employees. The construction industry involves a huge number of legal issues in a wide variety of different areas. I always found the legal issues fascinating and believed that a solid understanding of the law and ability to resolve complex issues is a huge advantage in business.
Q. What inspired you to found the Cowan Law Group?A. When I originally went to law school, I intended to use my legal training to help me with the construction business I started. However, I found I have a real passion for helping individuals and small to medium-sized companies resolve their legal and business problems in ways that make good business sense.
Q. How is the Cowan Law group different from other law firms?A. There are far too many firms that provide little to no value to their clients, and many that create more problems than they resolve. In many instances, the attorneys are good, smart people, but they don’t have the background or business savvy necessary to provide truly strategic, cost-effective legal solutions to their clients. This is a real problem because a good attorney who understands not just the legal issues, but also his client’s business challenges and objectives, is a tremendous resource and strategic advantage. With that in mind, I created the Cowan Law Group, whose main mission is to provide legal services that are smart, creative, and practical.
Q. So what makes you a good lawyer and advisor?A. I have benefitted greatly from a first class college and legal education. What I believe is even more important, however, is my life experience. Starting at a very young age, I have had to overcome many challenges both personally and in business. As a lawyer and advisor, these experiences have been invaluable because, through them, I have developed an ability to look at problems and challenges and know how to navigate through them in ways that are smart and effective.
But what is most telling is what my clients say. Over the course of my legal career, I have successfully resolved over $700 million of legal disputes in many different areas, including general business, real estate, construction, employment, and trade secret litigation, and I have handled a large number of business transactions. My clients often tell me that I provide counseling that is practical and mindful of business priorities, and that I handle it all well.

What, exactly, is probate?
The term “probate” refers to a variety of legal procedures which involve the transfer of a person’s assets after death and the conclusion of the deceased person’s affairs. The cost, length, and complexity of the available probate procedures vary widely. A consultation with a Texas Probate Attorney will typically be needed to determine which of these procedures are needed given your particular situation. Two of the most important considerations in determining the right probate procedure are:
1. Did the decedent die with or without leaving a valid written will?
When a decedent leaves a valid written will in Texas, he is said to have “died testate.” In these cases, the terms of the will dictate the distribution of estate assets to individuals or entities named in the will as beneficiaries. In these instances a probate lawyer will file an Application to Probate Will, after which a probate hearing is held to “prove up” the facts in the Application and further to ensure that the will is valid.

Lawyer fired in 9/11 case at Guantanamo

A Guantanamo Bay prisoner charged in the Sept. 11 attacks fired one of his military attorneys Monday in an apparent sign of distrust of his Pentagon-appointed legal counsel.
Waleed bin Attash at first refused to speak when questioned by the judge about his desire to dismiss one of his three lawyers, Marine Corps Maj. William Hennessy. He hinted at his motivation later in an exchange with the judge about whether he wished to attend future sessions of the court.
"We have been dealing with our attorneys for about a year and a half and we have not been able to get any trust with them," the Yemeni said through an Arabic translator.
The dismissal of the attorney came at the start of what is expected to be a four-day hearing to address a wide range of often abstract pretrial legal issues.
Bin Attash is one of the lesser figures among the five defendants in the Sept. 11 case. He allegedly ran an al-Qaida training camp in Afghanistan where two of the 19 hijackers in the terrorist attacks trained. He is also believed to have been a bodyguard for Osama bin Laden.
Defendants in the military tribunal have civilian counsel in addition to military lawyers. Khalid Sheikh Mohammed, who has portrayed himself as the mastermind of the Sept. 11 attacks, added an additional death penalty specialist, California lawyer Gary Sowards, to his team Monday.

Law firm: Phoenix lawyer dies from shooting wounds

A lawyer wounded by a gunman in a Phoenix office shooting this week has died, the second of three people hit by gunfire in the attack, the publicist for his law firm said Friday.
Mark Hummels, 43, had been on life support at a Phoenix hospital after Wednesday morning's shooting that killed a company's chief executive and left a woman with non-life threatening injuries.
Colleagues of Hummels described him as a smart, competent and decent man who was a rising star in his profession and dedicated to his wife, 9-year-old daughter and 7-year-old son.
The gunman — Arthur Douglas Harmon, 70 — was found dead early Thursday in the Phoenix suburb of Mesa from an apparent self-inflicted gunshot wound, police said.
Harmon opened fire at the end of a mediation session at a north-central Phoenix office building over a lawsuit he filed last April.
Steve Singer, 48, a father of two and CEO of Scottsdale-based Fusion Contact Centers LLC, died hours after the shooting.
Harmon targeted Singer and Hummels and "it was not a random shooting," police said. A 32-year-old woman not involved in the mediation was caught in the gunfire near the building entrance and suffered a gunshot wound to her left hand. |

Firm settles with W.Va. AG over mortgage case

A Texas law firm has reached an agreement with West Virginia Attorney General Darrell McGraw to resolve a case stemming from a national mortgage settlement.
Officials said Wednesday that Murray LLP has agreed to stop offering services in West Virginia to help homeowners receive benefits from a settlement between lenders and states.
Claim forms already were sent to more than 5,000 West Virginians who lost their homes to foreclosure eligible for payments under the settlement.
McGraw had sued the company earlier this month for allegedly charging fees to consumers for completing the claim form.
Officials say the company has agreed it would not represent or collect payments from West Virginia consumers in relation to the settlement. |

Court grants appeals from 2 people without lawyers

Well-heeled clients pay tens of thousands of dollars to hit the legal jackpot — Supreme Court review of their appeals. But on Tuesday, the court decided to hear cases filed by two people who couldn't afford or didn't bother to hire an attorney.
One was written in pencil and submitted by an inmate at a federal prison in Pennsylvania. The other was filed by a man with no telephone living on Guam.
Neither case seems destined to join the ranks of Gideon v. Wainwright, the landmark 1960s case filed by a prisoner with no lawyer that established a criminal defendant's right to a lawyer. Both show, however, that when the court is looking to resolve finicky legal issues and the right case shows up, it doesn't matter whether the author of the appeal wears a natty suit or prison garb.
Longtime Supreme Court practitioner Tom Goldstein called the granting of two such lawyerless cases at the same time "unheard of." But both cases chosen by the justices will help resolve the ability of civilians to sue the government over claims of improper actions of federal and military employees on the job.
Kim Lee Millbrook, a prisoner at the federal prison in Lewisburg, Pa., sued the government after accusing prison guards at the Special Management Unit of sexually assaulting him in May 2010. Prison officials said Millbrook's claim was unsubstantiated. |
