Supreme Court rejects blood transfusion case
Legal Focuses | 2014/12/01 15:25
The Supreme Court won't hear an appeal from the estate of a Michigan woman who died following a kidney transplant after turning down a blood transfusion because of her religious beliefs.

The justices on Monday let stand a state appeals court ruling that said the estate of Gwendolyn Rozier could not sue her doctors for negligence.

Rozier received a kidney from her daughter in a 2007 surgery but doctors later found that her body was rejecting the organ. She refused a blood transfusion, in keeping with the beliefs of Jehovah's Witnesses.

Rozier's estate accused the doctors of failing to timely recognize internal bleeding, among other allegations, which would have eliminated the need for a transfusion.

The Michigan appeals court said the transfusion was a necessary medical procedure under the circumstances.

Indian guru in deadly standoff due in court
Court Watch | 2014/11/21 16:19
An Indian guru at the center of a deadly standoff with police was set to appear in court Friday after he was arrested at his sprawling ashram for refusing to answer murder charges.

Nearly 15,000 supporters of the 63-year-old Sant Rampal were evacuated from his compound in Haryana state before police took him away in an ambulance Wednesday. Previous attempts by riot police to enter the fortified estate, about 175 kilometers (110 miles) from New Delhi, had resulted in deaths and injuries as Rampal's followers, some of whom were armed, fought back.

The self-styled guru was taken to Chandigarh, the state capital, to appear before a court Friday.

He has repeatedly ignored orders to answer a 2006 murder charge against him. Police have filed additional charges against him and some of his supporters, including sedition, murder, criminal conspiracy and detaining people illegally in his fortress, said Jawahar Yadav, a Haryana state government spokesman.

More than 400 people have been arrested and about 200 others injured, including security forces, during the dayslong standoff.

The guru's followers on Wednesday handed over to police the bodies of four women who apparently died inside the 12-acre (5-hectare) complex. Another woman and an 18-month-old child died in a hospital after leaving the ashram.

The circumstances of the deaths were not clear and autopsies were being conducted.

Man accused of pushing wife off cliff is in court
Lawyer News | 2014/11/13 15:51
Lawyers will argue Wednesday whether a man accused of pushing his wife off a cliff to her death in Colorado's Rocky Mountain National Park as they celebrated their wedding anniversary should remain in jail.

The federal detention hearing comes after Harold Henthorn, 58, was indicted last week on a charge of first-degree murder in the death of Toni Henthorn, 50.

An autopsy report says she fell or was pushed over the ledge when she paused to take a photo during a hike on Sept. 29, 2012. The couple was visiting the park for their 12th wedding anniversary.

Only after her death did Toni Henthorn's relatives realize she was covered by three life insurance policies totaling $4.5 million. A claim was sent in for one policy days after she died, court records show.

Harold Henthorn's attorney, Craig L. Truman, has said that the case is complicated and that "justice will be done" once the facts come to light.
